Terms of Service

Last updated September 22, 2026

These are the terms for using ResortKeeper. They are written to be read, not skimmed past. If something here surprises you, tell us before you sign up rather than after.

1. The agreement

By creating an account or using the software you agree to these terms on behalf of yourself and, if you are signing up for a business, that business. “ResortKeeper”, “we” and “us” mean ResortKeeper Systems, operated by Brixon Web Services, Colorado, USA. “You” means the facility subscribing and the people it authorizes to use the software. We record the version of these terms in force when your account is created.

2. What ResortKeeper is, and your license to use it

ResortKeeper is management software for pet boarding, daycare, grooming and training businesses, delivered as a web app, an installable PWA and a Windows desktop app. It is local-first: the working copy of your records lives on your own devices, and an internet connection is used to keep those devices in step, to run the client portal, and for a few features that need a server (AI briefing, sign-in, billing).

That design means the front desk keeps working through an outage of ours, your internet provider's, or Google's. It also means backups are yours to make. The app can export your data at any time and can schedule local backups; we recommend you do both. We are not responsible for data that existed only on a device that was lost, wiped or had its browser storage cleared.

License. While you are subscribed (or on trial, or on a founding arrangement) — or for good, if you hold a Founder licence (section 4a) — we give you a non-exclusive, non-transferable license to install and use the software for running your own facility. The software itself, its code and its design stay ours. You may not resell it, rent it out, reverse-engineer it, or use it to build a competing product. If you send us ideas, bug reports or suggestions, we can use them to improve the software without owing you anything for them — that is what the beta program is.

3. Your account

  • Keep your sign-in credentials private and tell us at once if you think they have been compromised.
  • You are responsible for what the people you invite do with their access, and for removing access when someone leaves.
  • The facility owner (admin role) controls the facility's settings, billing and payment gateway credentials.

4. Subscriptions, trials and pricing

  • Trial: new facilities get a 30-day free trial. No card is required to start it, and nothing is charged when it ends.
  • Billing: paid plans are billed monthly in advance by card through Stripe and renew each month until you cancel. Prices are shown on this site and in the app before you pay.
  • Flat pricing: your plan price does not depend on how many staff sign in or how many devices you use, and ResortKeeper takes no percentage of any payment you collect from your clients.
  • If a payment fails: Stripe retries the card. If it keeps failing, your plan lapses to unpaid: your data stays where it is and export keeps working, paid features may pause until the card is fixed, and nothing is deleted.
  • Your price is locked: if our prices change, you keep the price you signed up at for as long as you stay continuously subscribed. New prices apply to new signups, and to anyone who cancels and later returns.
  • Cancelling: you can cancel at any time from Settings → Billing in the app, which opens your Stripe billing portal, or by emailing us. Access continues to the end of the period already paid. Our refund policy is at /refunds.
  • Beta and founding plans: if you joined through the beta program, the acceptance email you received is part of your agreement with us. Where it says something different from these terms — a rate, a term length, a check-in commitment — the email wins for your facility.

4a. The Founder licence

The Founder licence is a one-time purchase, offered to no more than 25 facilities, instead of a subscription. If you buy one:

  • The licence never expires. You may use the software to run your facility for as long as you like, on every device you use for it. It is not a subscription with a long end date, and we will never convert it into one.
  • What it includes: everything in the Pro Resort plan, with no limit on boarders or staff seats, plus three years of updates and cloud services from the date of purchase.
  • After three years: cloud services and updates continue for $199 a year if you choose to renew. If you don't, the version you have keeps working and your data stays on your devices, fully readable and exportable. What stops is anything that runs on our servers: syncing between devices, the AI briefing, emailed report cards and waivers, the pet-owner portal and online booking, and new versions. You can renew later at the same $199 price.
  • The price does not change. $1,999 once, and $199 a year for the optional renewal, for as long as you hold the licence. Founder licences are not discounted and cannot be bought with a promotion code.
  • The licence file. Once the refund window below has closed, we send you a signed licence file. Installing it licenses a device with no connection to us. Keep a copy; if you lose it, we send the same one again.
  • Refunds: you can ask for a full refund within 14 days of purchase. After that the purchase is final, except where we charged you in error or the law requires otherwise. See the Refund Policy.
  • If you sell your facility, the licence goes with it. Tell us who the new owner is and we move it to their account.
  • If ResortKeeper is sold or shut down, the licence survives. A buyer takes it on as written. If the cloud services are ever discontinued we will give at least 90 days' notice, keep the final version available to download for that whole period, and keep export working throughout.
  • What it is not: a warranty that the software will run on every future browser or operating system, or that it is free of defects. Section 9 applies to Founder licences exactly as it does to subscriptions.

The full plain-English promise is in the app under Settings → Billing → What you own. Where it and this page differ, this page is the agreement.

5. Your data

  • You own it. Your clients, pets, bookings, records and ledger are yours. We claim no rights in them beyond what is needed to run the software for you.
  • You can take it with you. Export is available at any time in the app. We will not hold your data hostage on cancellation.
  • We don't sell it, mine it, or train on it. See the Privacy Policy for exactly who processes it and why.
  • You are responsible for its lawfulness — for having your clients' permission to hold their details, and for what you record about their animals and about them.

6. Payments you take from your clients

ResortKeeper lets you connect your own Stripe, Square or PayPal account and take payments through it. Those transactions are between you, your client and your payment processor, under that processor's terms. We are not a party to them, we do not hold the funds, and we do not charge a percentage on them. Disputes, refunds and chargebacks between you and your clients are handled through your processor.

7. AI features and templates

The daily briefing and other AI-assisted features summarize and suggest; they do not decide. They can be wrong. Check anything that matters — medication, vaccination status, capacity — against the record itself before acting on it.

The app ships with default documents such as the client waiver. They are starting points, not legal advice, and we do not promise they are enforceable where you operate. Have your own attorney review anything your clients sign.

8. Acceptable use

Don't use the software to break the law, to store content you have no right to store, to attack or overload the service, or to try to reach another facility's data. We may suspend an account that does, and will tell you why.

9. What we promise, and what we don't

We will run the service with reasonable care and skill, keep it secure as described in the Privacy Policy, and tell you honestly when something is broken. ResortKeeper is built and supported by one developer; support is by email and is answered by that developer.

The software is provided “as is”. We make no warranty of any kind beyond what this page says — including no implied warranty of merchantability, of fitness for a particular purpose, or of non-infringement. We do not promise it will be error-free or that cloud sync will be available at every moment; the local-first design exists precisely so your day does not depend on that.

Our liability is limited. To the fullest extent the law allows, we are not liable for indirect or consequential losses — lost revenue, lost data you did not back up, or claims your clients bring against you — and our total liability to you for any claim is limited to the fees you paid us in the twelve months before the claim arose, or $199 if that is more.

Nothing here limits liability that cannot be limited by law.

10. Ending the agreement

You can end it by cancelling. We can end it for a material breach of these terms that is not fixed within 14 days of us telling you about it, or if we discontinue the service — in which case we will give at least 90 days' notice and keep export available throughout.

11. Law and disputes

These terms are governed by the laws of the State of Colorado. Any dispute we cannot settle by talking will be brought in the state or federal courts located in El Paso County, Colorado.

12. Changes to these terms

Your price is locked as described in section 4. The terms themselves can change — for example when we add a subprocessor, change a feature, or have to fix something for legal or security reasons. We will post changes here, update the date at the top, and tell existing subscribers in the app and by email at least 30 days before they take effect. If a change is materially worse for you, you can cancel before it takes effect and we will refund the unused part of your current month.

13. The rest of the legal bits

  • If your use of the software gets us sued, you cover it. If a claim is brought against us because of the data you put in, the way you used the software, or a document your clients signed with you, you will defend us and pay what it costs — and we will tell you promptly, let you run the defense, and not settle anything in your name without asking.
  • Things outside our control. Neither of us is in breach for failing to do something these terms require because of events we could not reasonably prevent — a natural disaster, an outage at Google or Stripe, a government order, and the like. Your payment obligation for service already delivered is not one of those things.
  • Handing this agreement to someone else. You may not transfer your subscription to another business without telling us, though we will not refuse without a reason. If ResortKeeper is ever sold or handed to a successor, the successor takes on these terms as written — including your locked price — and you will hear about it from us before it happens, with the export door open as always.
  • If a court strikes part of this out, the rest still stands.
  • This is the whole deal. These terms, the Privacy Policy, the Refund Policy, and — if you are a beta tester — your acceptance email are the entire agreement between us. Nothing said in a sales conversation, a forum post, or a newsletter changes them.
  • How we reach each other. We send notices to the email address on your account; you send them to [email protected]. A notice counts as received the business day after it is sent.
  • No waiver by patience. If either of us lets something slide once, that does not mean we have to let it slide again.

Questions about this policy: [email protected]. ResortKeeper is built and operated by one person, so you will get an answer from the person who wrote the software.

ResortKeeper

ResortKeeper is built by one developer, on purpose. No investors expecting a return, no acquisition exit, no growth team hunting for new fees to invent — which means no one to answer to except the shops that use it. The overhead stays low so the price stays flat. You focus on the animals; the software stays out of your way.
